Health Benefits of Hemp Oil

By Ross Bridgeford Hemp oil has long been recognised as one of the most versatile and beneficial substances known to man. Derived from hemp seeds (a member of the achene family of fruits) it has been regarded as a superfood due to its high essential fatty acid content and the unique ratio of omega3 to omega6 and gamma linolenic acid (GLA) - 2:5:1. It is this ratio that is believed to be optimal in terms of improving skin conditions such as eczema, psoriasis and acne. It has been reported that those using hemp oil as a supplement begin to experience noticably softer skin, stronger nails and thicker, smoother hair after only a few weeks. The oil is approximately 57% linoleic (LA) and 19% linolenic (LNA) acids, the EFAs known as omega6 and omega3 respectively. Hemp Seeds EFAs can also be obtained from eating hemp seeds. These seeds also pack a significant protein punch, which rivals that of soy. Hemp Oil Preparation As with all essential fatty acids, hemp oil must not be heated or fried and it is very succeptable to heat and light. The oil is extracted from the seed by a slowly rotating press. The pressure from this press squeezes the oil from the seed and leaves only the remaining seed-cake. This is always done in an oxygen-free environment, as exposure to oxygen can rapidly depreciate the quality of the oil. Always ensure that your oils are prepared in such a way (i.e. without excessive heat, light and oxygen) and always store hemp oil in the refrigerator, use quickly, and never heat. Is it Illegal? In short, no. The Latin name Cannabis sativa actually translates as useful hemp! The confusion and concern often arises due to the fact that hemp seed/oil is derived from the plant Cannabis sativa, which is often incorrectly linked to the psychoactive substance, marijuana. The psychoactive ingredient of marijuana is the chemical THC, however the quantities of THC in hemp oil are so small that they are regarded as insignificant. In fact, for commercial hemp oil products to comply with Government regulations, they must contain less than 10ppm THC, which is very, very little. However, in the majority of products absolutely none can be detected. It would be almost impossible for this level of THC intake to measure even close to illegal levels during a drug urine test. Commercial or Informational? - Your Choice

By Mikki Barry An issue has been brewing almost since the inception of Google AdWords, regarding who “owns” what rights to which words. Trademark holders and business owners alike have been calling “foul” when a competitor uses their name, product name, or trademarked slogan in order to cause their advertisements to appear either in the Google search results (by use of meta tags or otherwise using the keywords in their website itself), or by purchasing those words via Google’s AdWords which would then cause their ads to appear in the sponsored sections of the search pages. In this particular case, Office Depot has sued Staples, claiming that Staples linked to words that are Office Depot trademarks, causing Staples ads to come up on searches for “Viking,” which is a subsidiary of Office Depot. Office Depot claims trademark infringement, false advertising, unfair competition, and deceptive trade practices. So what’s going on here? Does a trademark mean that you then “own” that word or that phrase, and nobody else can use it ever? Can the “trademark police” stop you from using the words “Office Depot” unless you’re talking about them specifically, including disallowing anyone from saying they are a store “like Office Depot?” Trademark Infringement Let’s take a look at the claims that Office Depot are making against Staples. First in line is trademark infringement. Trademark law is carved out of our general ability to use words in any way we choose (in the US anyway) in order to protect consumers against inferior products, by clarifying the source of a product or service so that you can be certain that an “Office Depot Product” was actually made by Office Depot and not by someone else. It is relatively clear in this case that a consumer would not be confused in the least by clicking on an advertisement for a shop that does not claim to be Office Depot, or have Office Depot in their domain name. If I were the judge, I’d throw that one out on its nose. False Advertising How about false advertising? Well, since Staples isn’t claiming to be anything but Staples, how could they be advertising falsely? The advertisement they have created is purportedly true. The only difference is that the mechanism by which the ads are shown. Is this false advertising? Not in my opinion anyway. It could, in fact, be argued that use of competitor’s words in search engines are pro-consumer in that it provides the consumer with far more choices then they would otherwise find. Unfair Competition Unfair competition? Now that one is a possibility. Unfair competition laws are set to protect companies against other companies, rather than protect the consumer against companies, as trademark law and false advertising are set up to do. Unfair competition actions grew out of trademark infringement law to prevent one trader from diverting patronage from a rival by falsely representing that his goods were the goods of his rival. But wait a minute here; Staples wasn’t passing off their goods by saying they were actually Office Depot’s goods. Again, there was no likelihood of confusion or misunderstand as to the source of the product. So that one doesn’t work terribly well either. Deceptive Trade Practices That leaves us with deceptive trade practices. So what ARE deceptive trade practices? The Federal Trade Commission defines prohibited activities in the Uniform Deceptive Trade Practices Act as: 1) Passing off goods or services as those of another. Well, that looks a lot like unfair competition and trademark infringement. 2) Causes likelihood of confusion or misunderstanding as to the source or approval of goods or services; or an affiliation with or certification by someone else. Does a listing on a search engine imply an approval, affiliation or certification? Not to any consumer who has used a search engine for more than 15 minutes :-). Doesn’t seem like this one fits either. 3) Uses deceptive representations or designations of the geographic source of the goods or service. Nope, don’t see any of that here. 4) Represents that goods or services have sponsorship, approval, characteristics, ingredients, uses or benefits that they don’t have, or that a person has some sponsorship, approval or connections that he or she does not. Office Depot hasn’t claimed anything about the goods themselves, just that they are being advertised by purchasing words from AdWords that correspond to Office Depot protected words. So that doesn’t work either. 5) Represents that the goods are original or new when they are not. See #4. 6) Represents that goods or services are of a particular standard, quality or grade, or of a particular style or model, when they are not. See #5 7) Disparages the goods, services or business of someone else by false or misleading representations. If you believe that simply displaying someone else’s goods disparage yours, perhaps this one will fly, but likely not. So what is the real point here? So if such a cursory view by another attorney shows the large holes in the claims of this lawsuit, why file it? What is the point? It is highly possible that Office Depot has filed this suit in order to bring attention to the practice of competitors ensuring that their advertisements are shown along with their competitors’ in hopes that Congress takes up the issue and passes new laws or modifies current laws to prohibit the practice. However, prohibiting the use of competitor’s words, products or phrases in meta tags or programs like AdWords would likely create much more difficulty than it solves. As a consumer, one uses a search engine in order to find the best product, the best price, or information on that or similar products to fulfill your current needs. It is in the best interest of the consumer to provide as much information as possible so that the consumer would be able to make the best choice for that particular consumer’s circumstances. The question comes down to a familiar one - should the Internet be primarily an outlet for information, or for commercialization? If you choose information, then anyone should be able to use whatever meta tags, adwords, keywords, or text that they desire, so long as they are not in violation of laws that protect consumers from poor quality, or confusion as to the source of a product or service. This would leave the constitutional right to “bash” particular products, use parody, satire, or simply mention products on your website and then sell AdWords to further promote your blog or whatever else you wish to promote. On the other hand, if you choose commercialization, use of trademarks in meta tags, on your website, or in AdWords would be prohibited, necessarily limiting the amount of easily accessible information on ANY subject, not just regarding products or e-commerce interests. Like, in United States of America or United Kingdom, where summer is the best time for annuals, and that is just opposite to ours. In India, we get our annuals, mostly in winter. The sunlight and water requirements of plants are also varied deeply from them as being a hotter and humid place compared to others. There are some annuals which are almost impossible to grow here, without some artificial aid, like greenhouse, humidity controller, etc. But in reverse, we have some which can be grown and propagated with very little care and cost. For the sake of simplicity, let us call the court of the first proceeding that initially set bail “The First Court” and the court where the subsequent arrest was arraigned “The Second Court.” In short, the second court may revoke the bail set by the first court and the defendant may be held in custody without bail for up to 60 days or until the first proceeding is resolved. The second court only has the power to revoke bail. It may not modify it or add conditions of release. To quote the Massachusetts law that gives the second court this power, a defendant who is arrested while on release pending the adjudication of a prior charge may be held for a period not to exceed sixty days upon a showing of probable cause for the new arrest and a finding, in the judge’s discretion, that “the release of said prisoner will seriously endanger any person or the community.” The governing law is Massachusetts General Laws Chapter 276, Section 58. It is very important for the defendant to hold the government to the probable cause standard via a full probable cause hearing with witnesses, and not to allow the Commonwealth to proceed via proffer (ie relying on police reports alone). In making the determination on bail revocation, the second court will consider the following factors: * nature of the offenses * conviction record * whether threats of force or violence was involved * whether there are pending appeals or sentences * defendant’s mental condition * potential for illegal drug distribution or present drug dependency The potential for a second arrest while on bail is greatest in 209A Restraining Order cases where violations of the restraining order, intentional or not, are frequent occurrences and usually concern the same parties. Ten Considerations Before You Buy A Bird House

By Donald Rohde When you decide to buy one bird house or more — be aware that there are many designs being sold that are unsuitable for the birds. These houses may not attract any birds or the types of birds you wish, or they may actually be harmful. Many are very cute and look like little decorated houses. There is nothing wrong with these, but they are usually more appropriate as indoor decoration than as good safe homes for wild birds. Below is a checklist of the ten most important features of a good working bird house. Before you put a house out for wild birds, be sure it has these ten features. If it is decorative and still has these features, then it is fine to put it out. The Ten Things: 1. No Perch Tree holes in the wild have no perches, so the birds that use nest boxes do not need them. They can be a disadvantage in that they may attract House Sparrows, an invasive species that often takes over nests from our native hole-nesting birds. 2. Diameter Of Entrance Hole Most of our common hole-nesting birds can use an entrance hole 1-1/2 inches in diameter. This size also keeps out Starlings, another invasive species that takes over nest boxes from native species. 3. Inside Flooring Dimensions The inside dimensions of the box are important and should be at least 4 inches by 4 inches so that there is room for the young to develop. 4. Overall Height Of House The distance from the bottom of the entrance hole to the floor of the box should be at least 5 inches. This keeps the developing young well down in the box and away from predators that might approach the entrance hole. 5. Easy Access For Cleaning You must be able to open the box, either on the side, front, or top. This helps in two ways: to monitor the progress and health of the young; and to clean out the box at the end of the season. 6. Ventilation There must be holes or slits at the top of the box sides or along the top of the front of the box to let hot air out when the sun beats down on the box in summer. 7. Drain Holes The bottom of the box needs to have holes or cut off corners to allow any water to drain out of the box. 8. Mounting Check to see if there is some way that you can attach the box to a pole, such as holes or a bracket. 9. Wood Material Of Choice Be sure that the materials the box is made of are 3/4 inch thick wood or a similar material that will insulate the birds from cold and heat. The only exception to wood is Purple Martin Housing — many are made out of Metal. 10. Roof Overhang The roof should overhang the entrance hole by 1 to 2 inches.
